Under the Australian Migration Act 1958 you may qualify for a Partner – Interdependency visa which allows persons in a same sex relationship with an Australian citizen, permanent resident or eligible New Zealand citizen to apply for a temporary and permanent visa to live in Australia.
What is an interdependent relationship?
An interdependent relationship is defined as a relationship where a couple have a mutual commitment to a shared life, to the exclusion of any other opposite sex or same sex relationships.

Who is eligible for an Interdependency visa?
To be eligible for an Interdependency visa you must:
- Be at least eighteen years of age.
- Show that you and your sponsor have a mutual commitment to a shared life to the exclusion of all others. At Taylor & Scott Lawyers we are experts in assisting you to gather and arrange the required evidence to show this commitment.
- Show that you have a genuine and continuing relationship with your sponsor. Here at Taylor & Scott Lawyers we can assist you in gathering the necessary material required to show a genuine and continuing relationship.
- Show that you and your sponsor have been in an interdependent relationship for twelve months prior to making your application. (This period may very rarely be waived if you can demonstrate compelling and compassionate circumstances such as cohabitation being illegal in the country where you lived.)
- Demonstrate that you and your sponsor are living together, or if not together, that any separation is temporary for not less than twelve months.
- Meet certain health and character requirements.
What will an Interdependency visa allow me to do?
An Interdependency visa will allow you to enter and remain in Australia on a temporary visa for two years, after which time you will become eligible for a permanent visa if your relationship is still continuing.
