Yes! The motor accidents legislation in NSW has very strict time limits in notifying the police and the insurer of the vehicle at fault that you will be making a claim for compensation. These time limits include:
• Reporting the accident to the police (if they did not attend the accident) within 28 days of your accident;
• Completing an “Accident Notification Form” and lodging the form with the insurer within 28 days of your accident;
• Completing a “Personal Injury Claim Form” and lodging this form with the insurer within 6 months of your accident.
It is important that these forms be lodged within the time set out above. When these forms are lodged with the relevant third party insurer of the car at fault, the insurer will be aware that you intend to make a claim for personal injury.
How do I know who to lodge the claim form with? Taylor & Scott can identify the relevant insurer for you. We can also assist you in completing the claim forms and lodge those forms on your behalf with the insurer.
So what do I do?
• Obtain the registration number of the car at fault;
• Try and identify the make/model of that car at fault;
• Ask the Police for an “E” number (this will allow us to get the police report on your accident);
• Make a note of the street and direction you were travelling in at the time of the accident;
