Taylor & Scott Lawyers recently had an outstanding result in the High Court in relation to a client’s negligence claim.
Our client suffered severe injuries in a motor vehicle accident in 2001 whilst travelling home from work with his employer. The truck they were travelling in broke down, our client was instructed by his boss to get under the vehicle and on instructions from a towing company, remove a tail shaft which led to the truck dragging our client 100 metres down the road, crashing into a barrier.
A claim was commenced against the motor vehicle insurer and also the towing company alleging negligence. We were successful in the New South Wales District Court and New South Wales Court of Appeal.
The towing company applied to the High Court seeking special leave to appeal the New South Wales Court of Appeal’s decision, however their application was dismissed by the High Court.
