The NSW Workers Compensation System provides a much-needed safety net for workers injured in the course of employment. Our expert lawyers will guide you through the deadlines and requirements under the Scheme.
Workers Compensation Assists Injured Workers
If you are injured at work, you may be eligible for benefits covering lost wages, medical expenses and vocational rehabilitation.
Surviving family members of workers who die due to work-related injuries or who passed away later as a result of a work injury can also claim compensation. Additionally, you might pursue a Work Injury Damages claim against your employer.
Insurance Coverage for Medical Bills and Lost Wages
The Workers Compensation scheme in NSW has been set up to assist injured workers and their families to get through the recovery period.
The insurance scheme helps pay for:
- Medical bills, hospital stays and rehabilitation costs.
- Lost wages if you miss work due to the injury.
- The difference in wages if have to take a lower-paying job due to the accident.
- A lump-sum payment for permanent injuries.
- Family support and funeral expenses.
Adherence to the Application Process
There are strict deadlines that you need to meet. The government has set time-frames that both employers and workers must comply with.
- Report the injury to your employer as soon as possible. You could lose your right to receive compensation if you do not let your employer know you’ve been injured. We suggest you consult with a lawyer right away.
- File a claim within six months of the injury.
- Seek appropriate medical attention and obtain a Certificate of Capacity from your GP. If you require time off work due to the injury, your doctor will need to note your capacity to work or not work and the limitations you may have.
Claims against Uninsured Employers
If your employer does not have Workers Compensation insurance, you can still file a claim through the government.
iCare NSW will investigate your claim to determine your employment status and whether the job duties contributed to your accident.
You Can Sue Your Employer For Negligence
In certain cases, you can sue your employer for negligence, especially if they failed to provide a safe working environment. These cases are complex and typically require consultation with an experienced workers' compensation lawyer.
