Damages payout following fall at work

Our client had recently secured a position with a supermarket. She had reported for work at the supermarket and completed the formal paperwork. She was then handed a uniform and sent to the staff change room to put on her uniform. Having changed, she exited the change room and took one step onto a tiled area when her feet flew out from under her. She fell very heavily onto the tiled floor suffering a number of injuries.

What she hadn't realised was that the company employed a cleaning contractor to clean various areas. The contractor had slopped water and detergent over the tiled floor. No barriers or warning signs had been posted to warn of the danger of the slippery floor. As a result of the fall, our client suffered injuries to her back, hip and neck. She was taken by her employer to a local doctor who ordered x-rays and recommended that she rest. After a few days, her pain was getting worse so she was referred to a specialist who ordered MRI scanning. Over the next several months, she underwent physiotherapy and hydrotherapy as well as having to take painkillers to try and manage her pain. As time went on, she has been left with ongoing pain in her lower back as well as pain radiating down her neck and hip. She has difficulty doing her household chores and has had to stop playing tennis or continue with her gym programme. Her sleep is now greatly disturbed and due to her pain, she feels depressed and socially withdrawn. Eventually, she got herself back to work but with reduced hours. Her pain now seems to be permanent. Her specialist has certified that she is now presently unfit for her pre-injury duties, particularly as they involve repetitive bending, lifting, carrying and being on her feet all day.

Having reviewed the facts and circumstances of the accident, the expert engineer was able to confirm the negligence of the cleaning contractors in causing the accident. Simon then made arrangements to qualify a consultant in occupational medicine to give an opinion on the effects of the injuries on his client's ability to work. Simon conducted the case on a no-win/no-pay basis.
