Recently, Andrew Woo (Lawyer and Migration Agent) has successfully helped clients obtain a health waiver and ultimately Australian Permanent Resident visas.  Andrew's primary applicant had been previously diagnosed with advanced colon cancer.

BACKGROUND TO THE CASE

Andrew's client and her partner were young and wanted to explore the world. They made a fateful decision to apply for student visas to study in Australia in 2012. After completing her studies at the Advanced Diploma level, Andrew's client was offered a full-time position to work on a 457 visa by her employer. When Andrew's client thought a rosy future lay ahead for her, she was devastated to find that she had been diagnosed with advanced colon cancer with two metastases in her liver. A series of urgent surgical procedures to remove the cancerous lesions in her bowel and liver were followed by intensive cycles of chemotherapy extending over several months.  Andrew's client remained extremely positive and was determined to get through this medical ordeal. Thanks to her employer's generosity, accommodating approach and support, she was able to continue working on a full-time basis whilst undergoing the arduous chemotherapy sessions and eventually, we are pleased to report, she became stable with no signs of any cancer recurrence.

Andrew's client and her employer submitted an ENS nomination and visa application to the Department of Home Affairs. In April 2019, Andrew's client was dumbstruck when her previous migration agent advised her that the MOC had determined that she did not meet the health requirement for permanent residency due to her history of advanced colon cancer.

The MOC's "Does Not Meet" finding prompted Andrew's client to seek advice from an expert in health waiver matters. We are very pleased to report that Andrew's submission on behalf of his client and her partner were successful and they have obtained ENS visas in June 2019, that is, less than 2 months following the health waiver submission prepared by Andrew.
