School team building compensation payout

Our client attended a high school in Sydney. One day the class were told that they were all going to participate in a team building exercise. A tug-of-war was proposed but as luck would have it, the teacher could not find the ropes used for this exercise.

The teacher then proposed a tyre rolling team event. The students were placed into groups and did a relay rolling a very large tyre, roughly weighing around 100kgs. Our client’s team completed their part of the relay and were directed by the teacher to sit on the ground near where the tyre was standing. Whilst our client and his group were seated on the ground, the tyre overbalanced and fell onto our client’s leg. In the accident, he suffered severe injuries to his leg. He was taken by ambulance to hospital where he underwent surgery on two occasions. He required several weeks off school as a result of these injuries.

Our client suffered nerve damage to his leg which has severely incapacitated him and has had a devastating effect on his sporting pursuits which included soccer and cricket. Our client’s parents turned to the team at Taylor & Scott for advice in respect to a possible negligence claim. It was clear negligence on the part of the school to leave a huge tyre standing on its end so close to where the students were sitting, knowing that the tyre could overbalance and fall onto the students.

Simon commenced an action under the Civil Liability Act suing the school for its negligence. Fortunately Simon and his team were able to negotiate an extremely favourable outcome for their young client in which he received compensation for the injuries and resultant disabilities that flowed from this accident. The settlement monies will be held in trust until this young person attains the age of 18 years.
