Our client was employed by a labour-hire company who then sent him out to work for various construction companies. On this occasion, he had been sent to assist a demolition company who had the contract to demolish a building in the Sydney CBD. At one point, he had been using oxy equipment to cut through steel. Having completed this particular task, he was walking over to talk to his boss to receive further instructions. As he walked, the demolition team who were using heavy machinery to break up a concrete floor were working nearby. At one point, the operator of one of the machines attempted to free up a steel pipe. As he did so, the pipe broke free and flew a distance striking our client in the back. He fell to the floor and was in immediate pain. His fellow workmates came to his aid and assisted him down to the First Aid shed. He rested, iced his back and eventually was able to make his way home. That night he remained in a great deal of pain but had hoped to try and work through the pain.

Having been examined in triage, he was admitted and came under the care of a Professor. The Professor diagnosed a disc and facet joint injury to his lower back. He recommended a conservative treatment of regular physiotherapy sessions, which included injections of a steroid into his back, as well as hydrotherapy. As a result of his severe ongoing pain, our client has not been able to resume his duties which include heavy physical work involving a lot of bending, lifting and carrying.
