Successful TPD claim brought by injured worker

Medical Treatment Visa Application Successful

Ray McClenahan, Accredited Specialist in Personal Injury, who also heads our TPD Department at Taylor & Scott, reports on a very happy ending.

Ray reported:

“Paul came to see me with a compensation claim. He was in his 50’s and had suffered a variety of injuries over the years. He needed a knee reconstruction and ultimately required a hip replacement. Because of these injuries, he had been unable to continue with his occupation as a labourer”.

Ray sorted out Paul’s compensation rights making sure that he received every dollar that he was entitled to and ensuring that all his medical treatment was paid for by the workers compensation insurance company.

Ray then sat down with Paul and carefully reviewed his entitlements under his superannuation. Ray advised Paul that he satisfied all the requirements in the definition of his super fund to make a claim for TPD (total permanent disability). Ray succeeded in getting Paul an extra $100,000 from his industry super fund.

Commenting on the claim, Ray said:

“It was a real pleasure to be able to assist Paul with his claim. He initially consulted me in respect to his compensation rights. Paul hadn’t realised that he would have a claim for TPD until we sat together. I reviewed all the evidence and supporting documents in Paul’s case and advised him that a TPD claim could be made.

Due to the fact that Paul’s working life had been severely impaired, Paul was very happy to receive the extra $100,000 that he had not been expecting”.

If you need compensation advice or if you would like advice on a total permanent disability (TPD claim), please contact the expert Ray McClenahan and his team at Taylor & Scott Lawyers.
