Andrew Woo (Lawyer and Migration Agent) helps a family of 3 submit a successful health waiver. One of the family members had been receiving biological treatment also known as Biologic Disease Modifying Antirheumatic Drug (B-DMARD) for his Psoriasis and Psoriatic Arthropathy (PsA) for a number of years.

BACKGROUND

Andrew's clients were NZ citizens who came to Australia in 2010 in pursuit of better employment opportunities and established their new home in Sydney. They were able to settle in fairly quickly including securing stable employment and settling in a new Primary School for their child.

On 19 February 2016, the Australian government unveiled a new visa pathway i.e. Subclass 189 (NZ Stream) Visa for New Zealanders living in Australia which was to commence on 1 July 2017. This was welcoming news for Andrew's clients who wanted to settle in Australia on a permanent basis. The health waiver applicant, however, developed pain in the joints and skin rashes which were subsequently found to be symptoms related to Psoriasis and PsA. Being from New Zealand, Andrew's client was, fortunately, able to have access to rather expensive B-DMARDs through Medicare and was able to have his symptoms under control. In 2017, the family submitted their application to the Department of Immigration and Border Protection to realise their dream of making Australia home. In November 2017, Andrew's clients were provided with information that the health waiver applicant did not satisfy the health requirement due to Psoriasis and PsA resulting in potential significant costs to the community in excess of $700,000.00.

INITIAL CONSULTATION & ACTION PLAN

After receiving the news, the health waiver applicant immediately reached out to Andrew who provided comprehensive advice and readily agreed to assist with the health waiver process for the whole family. Due to the time constraint and the Christmas closure, Andrew suggested that an extension be sought from the Department as a precaution. Andrew then carefully assessed and strategically built their case to address relevant factors of significance in collaboration with his clients.

SIGNIFICANT DELAY AND SUCCESSFUL OUTCOME

Despite Andrew and his clients' joint effort to provide any requested information in a timely manner, there had been a significant delay as a result of numerous requests for additional information which caused a great degree of frustration and anxiety. Andrew and his clients' patience and positive attitude for almost 18 months following the health waiver submission ultimately paid off as their permanent visas were approved in the end.
