TPD CLAIM BY SHOP ASSISTANT SUCCESSFUL

TPD CLAIM BY SHOP ASSISTANT SUCCESSFUL

Our client worked for many years as a shop assistant for a large supermarket chain. She loved her work and enjoyed the social contact with fellow staff and shoppers alike. Having finished a long day at the supermarket, she was involved in a serious motor vehicle accident when a vehicle travelling in the opposite direction lost control and crashed into her car. She was rushed to hospital by ambulance, treated and eventually released. As a result of the accident, she suffered physical injuries to her neck, back and both arms. She continued to suffer from severe pain which has had a major impact on her ability to sleep. She is very easily fatigued and needs the support of her loving family to complete the household chores.

The physical pain she suffers has been compounded by a very serious psychiatric response to the accident. She is now hypervigilant, nervous, restless, depressed and socially withdrawn. From being a very open and happy, hardworking person, she now finds herself shying away from friends and has needed hospitalisation for her psychiatric condition on a number of occasions. She has been unable to return to her job, there being little prospect of a cure for her ongoing psychiatric and physical problems. She has turned to the experts here at Taylor & Scott for advice and guidance. Presently Simon Meigan, Partner and Accredited Specialist in Personal Injury and an expert in motor accident claims, acts for her in relation to the injuries suffered in the accident.

As she cannot work, she also sought our advice re a total permanent disability claim against her superannuation fund and their insurers. Michelle Meigan, who is a Senior Associate here at Taylor & Scott, has been advising her client in respect to her TPD claim. Michelle met with her client on several occasions and then approached her superannuation fund to investigate her TPD rights. Michelle discovered that there was a large component of TPD available to her client so she then went about gathering together the evidence needed to satisfy the trustee and their insurer of the permanency of her client’s total and permanent disability claim.

Michelle arranged for specialist examinations by an orthopaedic specialist and by a psychiatrist. Both were of the opinion that our client had been devastated by the accident and was totally and permanently disabled from returning to work. Michelle then completed all the claim forms that were required by the super fund. She then went on to make further written submissions to the fund in support of her contention that her client was totally and permanently disabled and would not work again.

We are very pleased to report that the fund and their insurers have finally relented and agreed to pay out Michelle’s client’s TPD claim.

If you or someone you know is unable to work through illness or injury, they may have rights to a TPD claim.
