wheelchairOur client was a concreter who had spent many years working on building sites. On this particular day, the boss had directed our client and a couple of fellow workers to carry a trowel machine weighing over 100kgs across steel reo reinforcing rods.

Beside the machine being very heavy and difficult to manhandle, the workers had to pick their way over the steel reo trying to ensure that they stayed on top of it. No planks had been laid for the men to walk on and needless to say, one of the men lost their balance causing our client to stumble and take the full weight of the machine. In doing so, he suffered an injury to his leg, back, shoulder, arm and hand.

Our client had to stop work, seek medical help and go on workers compensation. Eventually he contacted Ray McClenahan, Partner and Accredit Specialist in Personal Injury here at Taylor & Scott. Ray ensured that his client’s compensation rights were in order and eventually asked Simon Meigan, Partner and Accredited Specialist in Personal Injury, to advise if a negligence claim could be brought even though the accident had happened several years earlier.

Simon investigated the case, gathered medical evidence and launched a work injury damages claim against the employer and a negligence claim against the head contractor of the building site. Eventually settlement negotiations were entered into, resulting in a settlement of all claims ensuring that our client had the financial security needed for him and his family.
