Motor Bike Rider Hit By Car

FACTS OF MOTOR ACCIDENT CASE

Our client was a carpenter who was riding his motorbike one weekend when a car pulled out into his path causing him to be thrown from his bike onto the bonnet of the motor vehicle.

As a result of the car driver’s negligence, our client suffered injuries to his shoulder and knee. He was admitted to hospital and remained in Accident & Emergency overnight. He had several weeks off work but fortunately was able to get back to his pre-accident job as a carpenter, although he was still in pain.

THE GREENSLIP INSURER’S OFFER OF SETTLEMENT

Several months after the accident, our client received a letter from the car owner’s greenslip insurer. In the letter, the insurer made a small offer of settlement to wrap up the case once and for all. Our client was unsure what to do. He consulted his union and they referred him to Taylor & Scott’s motor accident compensation legal team for advice.

WHAT TAYLOR & SCOTT’S MOTOR ACCIDENT LAWYERS DID

Simon Meigan, who is an accredited specialist in personal injury law and a specialist in motor accident claims, made an appointment in order to offer a Free Case Assessment to his client. He saw the client and carefully reviewed the facts and circumstances of the accident. He then went on to review and analyse with the client the offer that the greenslip insurer had made to settle the case.

Simon advised that the offer was not fair and was far below what his client should have been offered. Simon agreed to act on a no-win/no-pay basis and went about obtaining evidence to support his client’s claim, particularly in respect to the possibility of future medical treatment that his client may need. Having gathered together all of the necessary evidence, Simon then arranged an informal settlement conference with the insurance company.

IT PAYS TO HAVE A LEGAL EXPERT ON YOUR SIDE

Simon negotiated with the insurance company. He pointed out the inadequacies of the offer that had been made. He argued that an allowance should be made for the possibility of future surgery and that a further allowance should be made for the time off work that the client would need if he did come to surgery.

SUCCESS

Simon was able to negotiate a settlement which was nearly five times the original offer that the insurance company had made to his client.

TAYLOR & SCOTT MOTOR ACCIDENT LAWYERS OFFER TO YOU

Our expert legal team in motor accidents offers a Free Case Assessment in every matter. If following the assessment, we believe the insurance company’s offer is fair, we will tell you and we will not charge you for this advice. If, on the other hand, we believe you have not received a proper fair settlement offer, we will advise you.

If you agree to allow us to act, it will be on a no-win/no-pay basis meaning we won’t get paid unless you are successful with your case. Often, insurance companies offer the bare minimum hoping that you will give up and not want to argue with them. Our team of motor accident personal injury lawyers will do everything they can to ensure that you receive “maximum compensation for the injuries that you have suffered”.
