Non-compete and Restraint Clauses

A post-employment restriction or ‘restraint of trade’ is a contractual term which seeks to restrict the freedom of an employee to engage in future work after they leave their current employment.

Not all such restraints of trade are enforceable, and employees do not always need to agree with a restraint.

When restraints are enforceable, breaching a restraint is serious, and can lead to compensation being paid to a former employer, and even injunctions to stop former employees working in particular jobs.
