Most Australian employees are covered by a “modern award” which sets out different minimum rates for different occupations or industries. If you are covered by an award that applies to you, your employer may be breaking the law by paying you less than the award rate of pay for your job.
An enterprise agreement might also apply to your job, and must be better off overall than the modern award that would otherwise apply to you.
You can also have an employment contract that is more beneficial to you than the modern award or enterprise agreement that also applies to your work.
The way all these instruments interact can be confusing, so it’s worth seeking legal advice on your rights.
