If you have received an unfavourable decision from the Department in relation to your visa application or your visa is facing cancellation, you may be eligible to apply for a review of the decision to the Migration Review Tribunal or the Administrative Appeals Tribunal. Alternatively, you may be able to make an application for judicial review of the decision to the Federal Magistrates Court, the Federal Court or the High Court of Australia. For some, a final application to the Minister to overturn the earlier adverse decisions and grant a visa to stay may be available.
If you are a visa applicant or holder you may seek a review of the visa application or a review of a visa cancellation. For overseas visa applicants, it is the sponsor in Australia who can seek a review of a visa refusal.
The application is required to be lodged in Australia with the appropriate fee.
If you are granted a review, there may be a complete hearing by a specialist Tribunal of all the issues relevant to a visa refusal or a visa cancellation. A decision will be made based on the merits of your application unfettered by the earlier adverse decision. In some cases, the need for a hearing by a Tribunal can be avoided by careful and expert presentation in writing of the facts in support of your case. We have obtained many successful outcomes for clients in these circumstances either by a written submission and/or by assisting at a Tribunal hearing.
